Thirteenth Judicial District Attorney General Bryant C. Dunaway reminds everyone that as of July 1, 2026 Kratom is now illegal in Tennessee.
Under Public Chapter 950, known as “Mathew Davenport’s Law”, possession of Kratom is a Class A misdemeanor. It is a felony to knowingly manufacture, sell or deliver Kratom, or to knowingly possess Kratom with the intent to manufacture, sell or deliver it.
Medical examiners must test for Kratom when a death is caused by a suspected overdose.
Physicians who order toxicology testing for suspected overdose cases or suspected neonatal abstinence syndrome are required to test for the presence of Kratom.
